These General Terms and Conditions of Sale and Use (hereinafter ‘GTCU’) apply to all use of the Abotsi Market website (hereinafter ‘the Marketplace’), accessible via the URL www.abotsimarket.com. These conditions govern the rights and obligations of users (buyers and sellers) of the Marketplace. Abotsi Market acts solely as an intermediary facilitating transactions between buyers and sellers. By accessing or using the Marketplace, you fully accept these terms and conditions. If you do not accept these terms, you shouldn't use the Marketplace.

2. Presentation of the Marketplace

Abotsi Market is an online platform (Marketplace) that connects independent sellers and buyers for the sale of diverse products. Abotsi Market does not sell products directly but provides the necessary tools to facilitate transactions. The Marketplace is dedicated to high-quality products, including textiles (clothing, accessories), artworks, decorative items, jewellery and event-related products.

Besides its purpose as an intermediary facilitating transactions between buyers and sellers, Abotsi Market can, for certain products, act as a direct seller by buying from its suppliers and reselling them on the platform. These products are clearly identified as being sold by Abotsi Market.

Abotsi Market is managed by Abotsi Group Sàrl, a company based in Lausanne, Switzerland, which acts as its legal representative

3. Acceptance of the Terms

By accessing or using the Marketplace, or by placing an order, you undertake to comply with these General Terms and Conditions of Sale and Use. You declare that you have read and accepted these conditions in their entirety. If you do not agree with these conditions, you must not use the Site.

4. Modifications to the Conditions

Abotsi Market reserves the right to modify these GTCU at any time. Changes will be posted on the Site and will take effect immediately upon release. It is your responsibility to consult these conditions regularly to be informed of any updates.

5. Access to and registration for the Marketplace

5.1. Access to the website
Access to the Marketplace is reserved for persons of legal age who are capable of entering into a contract. If you are under the age of legal responsibility, you must obtain the prior consent of your parents or legal guardians before using the platform. You undertake to provide accurate, complete and up-to-date information when you register on the Site.

5.2. Creation of a user account
To buy or sell products, you must create an account on Abotsi Market. When creating your account, you must provide personal information such as your name, address, e-mail address, and the necessary information for payment and delivery. You agree to provide accurate and complete information and to update it in case of change.

5.3. Account security
You are liable for the confidentiality of your login details (username and password). You must immediately notify Abotsi Market if you suspect any fraudulent use of your account.

6. Use of the Marketplace

6.1. User obligation
As a user, you undertake to:

• Comply with the laws in force, in particular those relating to the sale and purchase of products.

6.2.  Behaviour of buyers
Buyers may view products, place orders and make payments online. Buyers undertake to provide accurate information concerning their delivery and payment details. The buyer must also check the availability of products at the time of ordering.

6.3. Behaviour of sellers
Sellers may offer products for sale on Abotsi Market. Sellers undertake to:

• Offer products that comply with current legal and safety standards.
• Provide detailed and accurate descriptions of the products offered.
• Respect the delivery times announced and ensure the quality of the products.

7. Intellectual Property

All contents of Abotsi Market (in particular logos, images, texts, trademarks) are the exclusive property of Abotsi Group Sàrl or its partners. These are all protected by intellectual property laws, in particular copyright and trademark laws. Any reproduction, modification or use without prior authorization is prohibited.

8. General Terms and Conditions of Sale (GTCS)

The following conditions apply specifically to transactions carried out via the Marketplace.

8.1. Purpose of the Marketplace
Abotsi Market acts solely as an intermediary. Sales contracts are concluded directly between buyers and sellers. Invoices for orders are issued by the sellers in whose name the sale is made.

In the event that Abotsi Market acts as a direct seller for certain products, the company becomes a party to the sales contract. The corresponding invoices are issued directly by Abotsi Group Sàrl, and the obligations concerning shipping, the right of withdrawal and guarantees are assumed by Abotsi Market in accordance with the legislation in force.

8.2. Products and prices
The products offered for sale are precisely described on the Site, with prices indicated in € (Euro). Prices include applicable VAT but do not include shipping costs, which will be indicated separately when the order is placed.

8.3. Order
When you place an order, you undertake to purchase the products chosen at the price indicated. You will receive an order confirmation by e-mail. The sellers reserve the right to cancel any order in the event of an obvious error in the product description, fraudulent payment or product unavailability.

8.4. Payment
Payment for products is made via secure payment methods provided by the Marketplace, such as Stripe. Payments are collected by Abotsi Market on behalf of the sellers and paid to the sellers after deduction of any service charges.

8.5. Shipping
Products are shipped to the address provided by the buyer when placing the order. Sellers are solely liable for the dispatch and shipping of products in accordance with the stated delivery schedules.

For products sold directly by Abotsi Market, the company is liable for dispatch and compliance with the stated delivery schedules. In case of delay or problem, the buyer can contact directly the customer service of Abotsi Market.

8.6. Right of withdrawal
The buyer has a period of 14 days from receipt of the products to exercise his right of withdrawal, unless otherwise provided by law. Products returned must be in their original condition, unused and in their original packaging. The cost of returning goods is borne by the purchaser/buyer, unless the product is defective.

For products sold directly by Abotsi Market, the buyer may return the products or request a refund directly via Abotsi Market's customer service, in compliance with the withdrawal conditions in force.

8.7. Warranties and returns
Sellers are liable for applicable legal warranties, in particular those relating to hidden defects or lack of conformity. In the event of a defective product, buyers must contact the seller directly.

Abotsi Market provides a guarantee for the products it sells directly in accordance with the legal provisions relating to conformity and hidden defects. For any claim or request related to these warranties, the buyer may contact Abotsi Market's customer service directly.

9.Protection of Personal Data

9.1. Data collection
Abotsi Market collects personal data necessary for the management of orders and the relationship with its users. This information is collected in accordance with Abotsi Market's Privacy Policy.

9.2. Use of data

11. Limitation of Liability

Abotsi Market acts solely as an intermediary and is not a party to the sales contracts concluded between buyers and sellers.

For products it sells directly, Abotsi Market assumes full responsibility as a party to the sales contract. This includes obligations relating to product conformity, warranties, delivery times and handling of returns.

12. Applicable Law and Dispute Resolution

These GTCU are governed by Swiss law. Any dispute relating to the use of the Site or to transactions carried out on the Marketplace shall be subject to the exclusive jurisdiction of the courts of the canton of Vaud, Switzerland.
